Terms of Use

Last updated: [PREENCHER 4 — data]

These Terms govern your use of bloomholm.com and every order placed with us. Please read them before ordering. By placing an order, you confirm that you accept them.

1. Who you are contracting with

The seller is [PREENCHER 1 — razão social], 500 4th St NW, Suite 102 #1963, Albuquerque, NM 87102, United States of America, EIN [PREENCHER 3], represented by [PREENCHER 2] ("Bloomholm", "we", "us").

2. Who may order

You must be at least 18 years old and legally able to enter a contract. We sell to consumers. Orders that appear to be for commercial resale may be declined.

3. How a contract is formed

Product listings are an invitation to buy, not a binding offer. When you complete checkout you make an offer to purchase. The contract is formed when we send you an order confirmation email. If we cannot fulfil an order — because an item is unavailable, because a price was displayed incorrectly, or because we cannot ship to your address — we will tell you and refund you in full.

4. Prices

All prices are shown in the currency of your selected region. Shipping costs, where they apply, are shown before you confirm payment. Prices do not include local import duties or taxes, which may be charged by your customs authority on arrival and are payable by the recipient — see our Shipping Policy. Prices may change at any time, but a change never affects an order already confirmed.

We do not use permanent strike-through pricing or artificial countdown timers. When a price is reduced, the reference price shown is the price genuinely charged before the reduction.

5. Payment

We accept the payment methods displayed at checkout. Payment is taken at the time of order. All transactions are processed by certified payment providers over an encrypted connection. We never store your card details.

6. Delivery

Delivery windows are stated in business days on each product page and repeated in your confirmation email. They are estimates based on carrier performance, not guarantees, and can be affected by customs clearance, weather or carrier delays. We publish the real window rather than a flattering one. Full detail is in our Shipping Policy.

7. Product descriptions, measurements and images

We publish the actual dimensions in centimetres and the actual weight of every product, and we declare the real material — "borosilicate glass", not "premium glass". Photographs include at least one image showing the product held in a human hand, so scale is clear before you buy.

Colour reproduction varies between screens and natural materials vary slightly between units. Minor variation of this kind is normal and is not a defect.

Each product page also states what the product does not do. We would rather lose a sale than have you open a box that does not match what you expected.

8. What we do not claim

Bloomholm products are household and garden objects. We make no medical, therapeutic or health claims of any kind, and we do not describe our products as instant, permanent or total in effect. If you have seen a claim of that kind associated with our brand, it did not come from us — please report it to service@bloomholm.com.

9. Intellectual property

The Bloomholm name, logo, island symbol, product photography, copy and site design are our property or licensed to us. You may not reproduce, distribute or use them commercially without our written consent.

10. Your content

If you send us photos or reviews, you grant us a non-exclusive, royalty-free right to use them on our site, in emails and in advertising, alongside your first name and country. You may withdraw this at any time by writing to service@bloomholm.com.

11. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of an essential contractual obligation, and then only for the foreseeable damage typical of this kind of contract. Nothing in these Terms excludes liability that cannot be excluded by law, including under product liability legislation.

12. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including customs action, carrier disruption, natural events or measures taken by public authorities.

13. Changes to these Terms

We may update these Terms. The version in force is the one published on this page at the moment you place your order. Material changes are dated at the top of the page.

14. Severability

If any provision of these Terms is found to be invalid, the remaining provisions stay in full effect.

15. Applicable law

These Terms are governed by the laws of the State of New Mexico, United States. This choice of law does not deprive you, as a consumer, of the protection afforded by the mandatory provisions of the law of your country of residence.
